Property sales to foreigners have come to a halt due to the lack of the new regulation which had to be made in three months by the council of ministers after the Constitutional Court’s overruling decision.
The chairman of TOKİ Mr. Bayraktar said “the new regulation will be done in 2- 3 weeks time thus the sales to foreigners will keep going on as it was before”. The minister of finance Mr. Unakıtan said that the new regulation has been submitted to the Council of Minister. “Only a few of the minister’s signatures are missing, we will push it to the parliament as soon as possible” says Mr. Unakıtan.

The turkish property market:
A vast and diverse country that straddles Europe and Asia, Turkey is blessed with some of the best coastline in Europe, especially in the country’s southwestern corner where the Mediterranean and Aegean Seas meet.
Primarily because of the low property prices – Turkey has received favourable comparisons with the Spanish property market in the 1970s – the country is touted as one of the next hot spots by aficionados. Agents Knight Frank predict property prices will increase by 12.5% in 2007, placing Turkey in its top 10 best markets for this year.
The advent of low-cost airlines servicing the southwest (currently scheduled airlines only fly into the region, taking 4-5 hours from UK airports) would create a big up-lift in popularity and prices. Already, easyJet flies to Istanbul, the biggest city, which has become very fashionable in the last couple of years. Trendy Western-style bars and clubs have opened up alongside the more traditional Turkish cafés for which the city is best known. The fusion is an intoxicating blend, one that is becoming ever more attractive to foreign buyers because of recent changes to Turkish mortgage law.
The reforms – which were recently passed by the Turkish parliament and will come into effect on 1 January 2008 – will facilitate mortgages at affordable rates for the first time in the country. Consequently, it is estimated home ownership numbers will increase from the current 4.5% to 12% by 2015.
"The new legislation will dramatically impact on the property market and marks a major step towards improving access to the property market for the smaller number of overseas property investors interested in Turkey in 2008,” says Simon Tweddle, head of research and analysis at Property Secrets.
“With current demand already outstripping supply in some areas of the country, and its sizable population of 70million on the increase, the market is primed to see property price growth. Demand for affordable property is at its highest level ever, with an estimated need for seven million homes over the next 10 years.

Since the beginning of 2005 only Estate Agents (Emlaks) holding a government licence have been allowed to sell land and properties in Turkey. Furthermore, Estate agents have to open a shop with a valid shop licence by law. Both documents are necessary (not only the agent's certificate).
Please ask every person in Turkey you will meet and who wants to sell you a property , about the documents and let show you all three of them!
Of course a lot of private Turks are selling properties too, but it is not allowed by law, too much happened in the past and made foreigners unhappy with a private purchase . Purchasers will have no guarantee by buying private.
It is sad but sometimes it happens, that private turkish people who do not have any legal rights to sell properties in Turkey, think that they have only to pretend to be a part of a company to be a business man. They feel helpless without a good recommended background. They use others company names for making their own (not always legal) business. Like it happened to us. Thank god, that reliable visitors, who met us in our office, did inform us about that cases.
If a real estate agent has got only his certificate but no own shop or a job in a licenced shop, no matter what he will tell you, he is not allowed to sell you a property at all !!!
